Terms of Service

1. Acceptance of Terms

By creating an account or using Task Manage (the “Service”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a binding agreement between you and Arizona Web Design (“we,” “us,” or “our”).

2. Description of Service

Task Manage is a cloud-based property management platform that allows landlords and property managers to manage properties, tenants, maintenance tasks, and maintenance worker teams. The Service also provides a tenant portal for lease viewing and maintenance request submission.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You must be at least 18 years old and have the legal authority to enter into these Terms to use the Service.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Input false, misleading, or fraudulent information about properties or tenants
  • Attempt to gain unauthorized access to other accounts or systems
  • Upload malicious code, viruses, or harmful files
  • Reverse-engineer, scrape, or create derivative works from the Service
  • Use the Service to harass, threaten, or discriminate against any person
  • Violate fair housing laws or any applicable landlord-tenant regulations

5. Your Data and Content

You retain ownership of all data and content you submit to the Service. By submitting content, you grant us a limited license to store, process, and display it solely to provide the Service to you.

You are solely responsible for the accuracy and legality of tenant data you enter and for complying with applicable privacy laws (including GDPR, CCPA, and state landlord-tenant statutes) when collecting and storing tenant personal information.

6. Payment and Billing

Certain features of the Service may require a paid subscription. Pricing, billing cycles, and cancellation terms will be presented at the time of purchase. All fees are non-refundable except as required by law or as expressly stated in our refund policy.

We reserve the right to change pricing with 30 days' notice to active subscribers.

7. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend or modify the Service for maintenance, security, or legal reasons. We will provide reasonable notice for planned maintenance where possible.

8. Termination

You may delete your account at any time from Account Settings. We may suspend or terminate your account if you violate these Terms, with or without notice depending on the severity of the violation.

Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

9. Intellectual Property

The Service, including its design, code, and trademarks, is owned by Arizona Web Design and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the Service.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARIZONA WEB DESIGN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Arizona.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
